What can bloggers do to avoid liability?

Just recently I had to delete one of my posts, that was published by one of my writer contributor, as someone alerted me (private email) that I should be careful of it's strong content advising me to do a little research on the subject of bloogers liability.

We all know of-course that here on ActiveRain we are all responsible for the content of our writing but to what extend that might be I am not so sure... Indeed it is a very serious problem:

Bloggers & Moderators are liable for blog and comments...It is a new reality out there in the blooging world. Blogs and forums have been successfully hailed into legal battles, and the current consensus is that the blogger must know the scope of their liability across the planet.

Digital Millennium Copyright Act (DMCA) was designed to protect web hosting services and ISP's and not specific web publishers, bloggers or chat room participants. Therefore you must be careful what you publish out there... you are personally liable for the content of your writings. Before you post your article make the extra effort to review your material with a fresh, detached, objective eye and make sure you did not cross any lines.

Blogers are held to account for what they say, whether or not they are quoting someone else. Unfortunately, the law has yet to create reasonable standards for the Internet and allows anyone to quote any source, with almost no liability for what they say... as long as it's just a quote. The liability should be entirely on the owner of that quote.

Allowing blog comments is also asking for trouble. Blog comments are now treated like "Letters to the Editor", that are published on your blog, at your peril... where the blogger has read and accepted comments on his/her blogging pages. I personally disable once in a while the comments on my blog or simply delete some that can be questionable ...

Safe-Blogging Tips

  • Don't write anything you wouldn't want your boss or your mother to read. Your words could last for years, so keep future relationships in mind.

  • Never divulge company secrets. That's grounds for firing.

  • Avoid saying anything that could hurt your business or reputation.

  • There is no First Amendment protection - right to free speech - in private employment. Think about that if you're tempted to express controversial opinions, use offensive language, or tell the world about your private life and fantasies.

  • You are more vulnerable if you blog on company equipment at work than if you use your own computer at home.

In other words... Be a responsible blooger and be aware of your liabilities.

Gambling on the water table ... water conservation in Las Vegas

UPDATE NEWS: Two of the West’s preeminent water organizations report Las Vegas Valley is sitting on an oasis of water and money savings. The report, "Hidden Oasis: Water Conservation and Efficiency in Las Vegas," was prepared by the Pacific Institute in Oakland, Calif., and Western Resource Advocates of Boulder, Colorado.

The report concludes that "installing water-efficient fixtures and appliances could reduce current indoor water demand by 40 percent in single-family homes and nearly 30 percent in hotels and casinos." Read the Report>>

Bundle of beauty and golden light!...

This is the time of the year when poppies explodes, spreading the bright golden color over miles and miles of fields and hills of California.

With the heavy rains this year the abundance of blooming poppies is overwhelming all the way from Mojave into costal area along 101 Hay to Monterey-Carmel and further up North San Francisco.

Visiting friends from Monterey I had the chance to enjoy the beauty of this incredible display of colors.

California poppy (Eschscholzia californica) the state flower of California, is native to the Pacific slope of North California. California's orange Poppy flowers grow fast in spring growth. Clouds, blue sky with regular rain storms and dusting of winter snow on the mountains. In this heavenly slice of California called Monterey it most certainly does.

 It was selected as the state flower by the California State Floral Society in December 1890, but the state legislature did not make the selection official until 1903.

The intense blooming season for the California poppy falls usually within late winter to early spring, during the months of mid-February through mid-May. Blooming seasons are dependent on the amount of rainfall during the winter to early spring seasons.
